BALTIMORE (AP) - A federal judge in Baltimore has rejected a church's
attempt to dismiss a defamation lawsuit filed by the father of a fallen
Marine after church members picketed his son's funeral.
US District Judge Richard Bennett rejected the church's contention that
the court was being asked in the case to decide between different
Albert Snyder of York, Pennsylvania, is suing the Reverend Fred Phelps
and his Topeka, Kansas-based church.
Church members demonstrated at the funeral of Lance Corporal Matthew
Snyder of Westminster, Maryland, last year and posted pictures of the
protest on their Web site.
The church claims that the death of American servicemen and women in
Iraq is God's punishment for US tolerance of homosexuality. Snyder'ssuit claims the church's free speech rights do not extend to funerals.The trial is scheduled for October.

I attended a funeral as a Patriot Guard in CT. Gov. Rell just signed into law the bill banning protests at funerals so they didn't show up. But there were over 200 of us there !
